Judge dismisses 25 claims of priest abuse
Most of the 103 claims for compensation from the Roman Catholic Diocese of Tucson stemming from allegations of sexual abuse by priests have been resolved.
Twenty-five claims were dismissed yesterday by the federal bankruptcy judge assigned to the case since the diocese filed for Chapter 11 protection Sept. 20, 2004.
Judge James Marlar also approved settlements yesterday of $15,000 each in 20 claims considered credible but too old to be considered under the statute of limitations.
Thirty claimants in 28 cases agreed earlier this month to settle, at an estimated value of about $10 million. Some of those claimants expect to receive at least $600,000 each.
Three other claims with validity are still being negotiated.
Outside the hearing yesterday, Lowell Rothschild, the attorney for the diocese's 75 parishes, made an offer of an undisclosed amount to the settlement fund that will be used to pay claimants.
Parishes that contribute to the settlement fund also are buying future immunity from civil suits that could be filed after the Chapter 11 reorganization plan is approved.
Those who don't contribute to the fund can expect to be sued if abuse took place in their parishes, claimants' attorney Lynne Cadigan has said.
